What personal data of yours does BBVA AM process?

  • If you are a holder or usufructuary of a product managed by us: BBVA AM may process the following categories of personal data: 
    • Identification and contact data (including postal and/or email addresses)   
    • Economic data related to orders. 
    • Signature data (including digitized and electronic signatures).
  •  If you are a representative or authorized person: BBVA AM may process the following categories of personal data: 
    • Identification and contact data (including postal and/or email addresses)
    • Data obtained from other sources. 
    • Data obtained from distributors: identification, contact, and economic data
    • Signature data (including digitized and electronic signatures).
  • If you are an institutional client, in addition to the data mentioned above, we may also process biometric data (voice).

At BBVA AM we ask you to keep your data duly updated to ensure that the data we process is accurate at all times. If you modify them, let us know, directly or through your distributor, so that we are aware of your current situation.

What do we use your personal data for?

  • If you are the holder of the contracted product:at BBVA AM we process your personal data to:
    • Process orders for the products you have contracted with us, directly or through your distribution entity (who, where appropriate, has transferred them to us) and inform you about them.
    • Monitor, analyze and manage queries, incidents or claims.
    • Comply with other obligations imposed by regulations on the occasion of the management and administration of the products you have contracted with us, directly or through your distribution entity. 
  • If you are a representative, authorized person, or usufructuary, we will process your personal data to process orders for the products in which you intervene due to your relationship with a BBVA AM customer.

Why do we use your personal data?

Below we explain the legal basis that allows us to process your data for each of the purposes indicated above:

  1. In fulfillment of a contract:
  • If you are the holder of the contracted product: to process orders for the contracted products, directly with us or through your distribution entity, who, where appropriate, has transferred them to us, and to keep you informed about them. 
  • If you are a representative, authorized person or usufructuary: we process your personal data for the execution of a contract in which you appear as a party involved.
  1. In compliance with the law:

BBVA AM must also comply with the legal obligations imposed, among others, by the (i) Law on Collective Investment Institutions and its implementing regulations; (ii) Law regulating venture capital entities; (iii) Law on the Prevention of Money Laundering and Financing of Terrorism and its implementing regulations; (iv) regulations on the prevention of insider trading and market abuse, as well as (v) current regulations on personal data protection.

How long will we keep your data?

We will keep your personal data for the duration of the contractual relationship.

Once the contractual relationship has ended, BBVA AM will keep your personal data blocked during the legal limitation periods, generally 10 years due to Money Laundering and Terrorism Financing Prevention regulations. After the legal limitation periods have elapsed, we will destroy your data.

To whom will we communicate your data?

We will not transfer your personal data to third parties, unless we are obliged by a law that is necessary for the execution of the contracted product, or that you have previously agreed with BBVA AM.

In the case of a transfer request, BBVA AM will have to communicate the holder’s personal data to the management entity or distribution entity of the destination Collective Investment Institution to which the transfer has been requested, by your order.

Likewise, BBVA AM informs holders that, in order to process and execute orders on the contracted product, it will be necessary to communicate their personal data to BANCO BILBAO VIZCAYA ARGENTARIA, S.A., as the depositary entity of the contracted CII.

Furthermore, BBVA AM may transfer data to the distribution entity through which you have contracted the CII so that it can comply with its legal information obligations or those others that they assume as a consequence of some other contract that you have signed with your distribution entity.

On the other hand, in order to provide you with an adequate service and manage the relationship we maintain with you as a customer, below you will find a list by category of the companies that process your data on behalf of BBVA AM, as part of the provision of services we have contracted from them.

We also inform you that, for the purposes indicated above, certain companies that provide services to BBVA AM may access your personal data (international data transfers). These transfers are made to countries with a level of protection comparable to that of the European Union (adequacy decisions of the European Commission, standard contractual clauses as well as certification mechanisms). Limitation of processing You will be able to request the limitation of the processing of your data in the following cases:
  • While the challenge to the accuracy of your data is being verified. 
  • When the processing is unlawful, but you object to the erasure of your data.
  • When BBVA AM does not need to process your data but you need them for the exercise or defense of claims.
  • When you have objected to the processing of your data for the fulfillment of a mission in the public interest or for the satisfaction of a legitimate interest, while it is verified whether the legitimate reasons for the processing prevail over yours.
Portability
You will be able to receive, in electronic format, the personal data you have provided to us and those that have been obtained from your contractual relationship with BBVA AM, as well as transmit them to another entity.
